Compliance, Deputy Director
Job Summary/Basic Function:
This position will be responsible for helping to ensure the University complies with Title IX of the Education Amendments of 1972 (Title IX), the Americans with Disabilities Act of 1990 (ADA), and Section 504 of the Rehabilitation Act of 1973 as amended (504), and other non-discrimination
statutes(Title VI, Title VII, etc.) and regulations through prevention, training, awareness, investigations and monitoring through case intake, helping to assign cases, etc. at the direction of the Assistant VP for Title IX, Institutional Equity, and Compliance. This position will also be responsible for conducting investigations of protected class discrimination and harassment allegations, allegations relating to grants and contracts, allegations of other university policy violations, assisting other compliance areas with investigations, and other matters as needed. Assists in institutional compliance risk assessment, mitigation, and monitoring. Provides support for parties to complaints. Helps facilitate and mediate informal resolutions between parties. This position will carry a subtitle of Deputy Title IX Coordinator.

Level Scope:
Manages a large team typically consisting of both experienced professionals and subordinate Managers. Focuses on tactical and operational plans with short to mid-term focus; significant responsibility to achieve broadly stated goals through subordinate Managers. Determines objectives, directs programs, develops strategies and policies, manages human, financial, and physical resources, and functions with a high degree of autonomy. Requires broad management and leadership knowledge to lead project or program teams in one department/job family. Proactively assesses risk to establish systems and procedures to protect organizational assets.
Essential Functions:
● Plan and conduct (or oversee) objective and timely investigations into complaints alleging discriminatory practices
● Help manage investigator’s caseload and assign cases.
● Conduct investigations into internal, external agency (e.g., EEOC, Idaho Human Rights Commission, Office for Civil Rights) and grantor complaints claiming:
● Discriminatory practices or treatment alleged to violate University nondiscrimination and anti-harassment policies, other violations of University policies; statutes or regulations; or University contractual obligations; co-investigate issues with SBOE Audit Advisory Committee.
● Oversee other Investigators within the office, review and correct investigative reports, and work with external investigators on cases.
● Oversee, train, and evaluate investigators in conjunction with AVP of Title IX, Institutional Equity, and Compliance.
● Create education plan for campus around civil rights law and policies, implement trainings .
● Contemporaneously document the investigation process, including: investigation plan, interview notes from complainant, respondent and witnesses, and other physical or electronic evidence gathered.
● Analyze applicable policies, laws, and/or contractual obligations to determine whether, based on all the evidence gathered in the course of the investigation, a violation has occurred. In the case of a violation, confer with relevant parties to determine appropriate responses, including recommendations for disciplinary action.
● Prepare, written investigation report with findings for review by the AVP.
● Help facilitate informal resolutions between parties by acting as a mediator .
● Developing and reviewing prevention and response programs and policies to address discrimination and sexual misconduct.
● Organizing and conducting university training and educational activities.
● Coordinating and participating in university and community committees.
● May perform other duties as needed.
Knowledge, Skills, Abilities:
● Experience drafting detailed reports, including careful analysis of evidence and evaluating credibility.
● Experience in editing detailed reports of others and analyzing if laws and policies have been correctly analyzed.
● Background in conducting investigations, performing interviews, and engaging in analytical review.
● Exhibit a clear understanding of working within higher education.
● Strong oral and written communication, analytical, and organizational skills.
● Ability to generate, cultivate, and maintain professional relationships with the local community partners and campus community.
● Established a history of working and communicating effectively with people of various backgrounds.
● Demonstrated knowledge of interpreting and applying complex statutes and regulations, especially those applying to nondiscrimination.
● Confidence in working independently, making decisions, and problem-solving.
● The demonstrated ability to remain impartial during the course of an investigation Knowledge of conflict resolution tactics and trauma-informed interviewing strategies.
Minimum Qualifications:
Bachelor’s Degree and 5 years experience or relevant equivalent with 2 managerial experience.
Preferred Qualifications:
● Juris Doctorate or other higher-level degree.
● At least 3 years of experience working in higher education.
● At least 2 years of experience working with victims of trauma.
● At least 2 years of experience investigating harassment or discrimination.
● At least 2 years of experience overseeing investigations.
Salary and Benefits:
Salary range of $95,056-$100,000/yr and is commensurate with experience. Boise State University provides a best-in-class benefits package, including (but not limited to):
