Rewriting the Athletics Playbook: Legal and Practical Issues Arising from Alston and NIL Developments 

The summer of 2021 has brought a torrent of change to collegiate athletics.  The U.S. Supreme Court, in NCAA v. Alston, struck down the NCAA’s restrictions on education-related benefits for student athletes as a violation of federal antitrust law.  Shortly thereafter, the NCAA adopted an interim policy across all divisions to provide uniform guidance on name, image, and likeness (NIL) opportunities for student athletes.  These developments have wide-ranging impacts on the policies, compliance systems, and practical expectations and assumptions around collegiate athletics programs for decades.  Counsel, institutional leadership, athletics staff, and student athletes are now left to traverse a radically changed landscape, and questions abound regarding the way forward.
