Position Description

Performs legal work involving representation and advice on legal matters in the Texas Tech University System Office of General Counsel.

Major/Essential Functions

  • Work with the Office of the Attorney General of Texas in defending lawsuits filed against the TTU System or its component institutions including, but not limited to, responding to discovery requests, preparing for and attending depositions and hearings, and filing motions.
  • Respond to complaints of discrimination by former or current students or employees that are filed with external agencies (e.g., EEOC, TWC-CRD, OCR, DOL) including, but not limited to, attending mediations, filing position statements, and participating in interviews. 
  • Draft, review, and advise regarding contracts of the Texas Tech University System and components, including, but not limited to, real estate transactions such as leases, easements, land acquisitions, and conveyances; construction transactions including construction manager at-risk agreements, design professional agreements, public art agreements, and design-build agreements; other general transactions such as IT software and licensing agreements, purchasing and services agreements, international transactions involving Texas Tech campuses and programs abroad (e.g., Costa Rica and Spain campuses), public-private partnership agreements, research-related contracts and grants, athletics agreements including game guarantee contracts and media/marketing/apparel rights; health care agreements such as master services agreements, affiliation agreements, and managed care agreements.
  • Provide legal advice on a variety of issues including, but not limited to, matters concerning the rights, obligations, and privileges of institutions of higher education, and federal and state regulatory matters.
  • Advise officials, faculty or staff of Texas Tech University System and components.
  • Review and interpret laws, regulations, proposed legislative bills, and internal policies affecting operations and administration.
  • Handle Texas Public Information act requests, including drafting and filing requests for Attorney General opinions.
  • Handle medical malpractice and professional liability matters.
  • Review/revise campus-wide policies and procedures.
  • Work with the Vice Chancellor and General Counsel on issues impacting the board of regents.
  • Attend and advise various TTU System component committees.
  • Engage in actions and communications that are consistent with the Texas Tech University System and component institution Values Culture.

Required Qualifications

Assistant General Counsel:
JD degree; Licensed to practice law in the State of Texas.

Associate General Counsel:
JD degree; five years experience as an attorney. Licensed to practice law in the State of Texas.

Preferred Qualifications

Assistant General Counsel:
Three years experience as a practicing attorney handling legal matters that are relevant to representing a public institution of higher education. Licensed to practice law in the State of Texas.

Associate General Counsel:
Seven years experience as a practicing attorney handling legal matters that are relevant to representing a public institution of higher education. Licensed to practice law in the State of Texas.

Based on experience and qualifications, this position could be offered as an Assistant General Counsel or an Associate General Counsel.  The preferred location for this position is the Texas Tech University Health Sciences Center in Lubbock; however, the position may be located at the Texas Tech University Health Sciences Center - El Paso OGC office as mutually agreed between the candidate and OGC. The pay rate will reflect the position to which a candidate is hired.
